France Nicotine Pouch Ban: What Travelers Need to Know

France banned nicotine pouches on April 1, 2026: buying, selling, importing, possessing and using them. What the decree covers, what a court suspended, and what it means if you travel.

By Sarah Chen

TL;DR

France banned nicotine pouches on April 1, 2026. Under Décret n° 2025-898 of September 5, 2025, importing, possessing, selling, buying and using oral nicotine products is prohibited on French territory. In December 2025, France's top administrative court, the Conseil d'État, suspended only the parts on manufacturing, production and export; the rest took effect as planned. If you're traveling, don't pack pouches for France.

In one sentence: Since April 1, 2026, you can't legally bring, carry, buy or use nicotine pouches in France.

What the decree bans

Décret n° 2025-898, published in France's official journal on September 6, 2025, covers oral products containing nicotine. Article 1 bans their production, manufacture, transport, import, export, possession, offer, transfer, acquisition and use in France.

According to the French government's service-public.gouv.fr notice:

  • Covered: nicotine pouches (sachets), and other oral forms such as beads, chewing gum, pellets, liquids and strips
  • Exempt: chewing tobacco, and medicines and medical devices used to quit smoking (for example, pharmacy nicotine gum or lozenges)
  • Start date: April 1, 2026, the first day of the seventh month after publication

What the court suspended

The decree was challenged in court. On December 22, 2025, the Conseil d'État (order n° 509561) suspended the decree only "en tant qu'il interdit la fabrication, la production et l'exportation" (insofar as it bans manufacture, production and export), pending a ruling on the merits. The bans on import, possession, sale, purchase and use were not suspended and have applied since April 1, 2026. We have not found a ruling on the merits as of this article's date.

If you're traveling to France

  • Don't bring pouches. Import and possession are both banned, so packing a can of ZYN or any other nicotine pouch for a trip to France puts you in breach of the decree.
  • Transport is covered too. Article 1 also bans transporting the products on French territory, and that part was not suspended.
  • Snus vs pouches. Norway's foreign ministry warned travelers in April 2026 that tobacco-free nicotine pouches are banned in France, while tobacco snus is not covered, as reported by The Local.
  • Quitting aids are fine. Pharmacy nicotine replacement products are exempt.

We've seen reports of large fines and possible prison time, but we couldn't verify the penalty against the French legal text, so we're not printing a figure. If you need certainty, check with the French embassy or consulate before you travel.

France isn't the only one

France is the third EU country to ban nicotine pouch sales, after Belgium (2023) and the Netherlands (January 2025), according to Euronews. Outside those countries, pouches are widely sold in the EU: on one large European marketplace, about half the pouches on sale are above 12mg. Our US vs EU nicotine pouches page tracks that data monthly.

In the US

There's no federal ban in the US. Nicotine pouches are regulated by FDA, the minimum age to buy them is 21, and FDA has authorized some products, listed in our FDA-authorized nicotine pouches guide. Some states restrict flavors or add taxes; see our state-by-state guide.

Nicotine pouches are for adults 21 and older. Nicotine is addictive.
